Yayasan Bakti Pendidikan Unggul — Terms of Use

1. Acceptance of Terms
This Terms of Use Agreement (“Agreement”) is a binding legal contract between you (“User,” “You,” or “Your”) and Yayasan Bakti Pendidikan Unggul (“the Foundation,” “We,” “Us,” or “Our”), a foundation established under the laws of the Republic of Indonesia dedicated to advancing educational excellence and access.
By accessing, viewing, or using the Foundation’s website (the “Website”), you signify that you have read, understood, and agree to be bound by all terms and conditions contained in this Agreement. If you do not agree with any part of these terms, you must not access or use the Website.
2. Purpose of the Website
The Website is intended to serve as an informational platform to showcase the mission, vision, programs, and activities of the Yayasan Bakti Pendidikan Unggul. The information provided is for general knowledge, promotional purposes, and to facilitate engagement with our educational initiatives.

4. Donations and Fundraising
Yayasan Bakti Pendidikan Unggul is a legally registered foundation (Yayasan) in the Republic of Indonesia and is organized to receive contributions and donations.
- Legal Compliance: Any public solicitation of funds by the Foundation is conducted in compliance with applicable Indonesian laws, including but not limited to Law No. 9 of 1961 regarding the Collection of Money or Goods (PUB) and its implementing regulations, which may require permits from the Ministry of Social Affairs or other relevant authorities.
- Use of Funds: All funds received, whether through donations, grants, or other contributions, will be used exclusively to support the Foundation’s stated mission and educational programs, in accordance with our Articles of Association (Anggaran Dasar).
- Financial Accountability: The Foundation is committed to transparency and accountability in the management of all received funds, in line with the principles of the Indonesian Yayasan Law (Law No. 16 of 2001 as amended by Law No. 28 of 2004).
D. Non-Refundable: All donations are considered final and non-refundable.
5. Prohibited Conduct and Use
As a condition of your use of the Website, you agree not to use the Website for any purpose that is unlawful or prohibited by this Agreement, including but not limited to:
- Posting or transmitting any unlawful, threatening, abusive, defamatory, obscene, or indecent content.
- Engaging in any activity that could damage, disable, overburden, or impair the Website.
- Attempting to gain unauthorized access to any part of the Website.
- Submitting false or misleading information, including in relation to any donation or partnership application.
- Using the Website to promote or solicit any commercial goods or services.

The Foundation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. Your use of third-party websites is at your own risk.
7. Disclaimers and Limitation of Liability
- A. Informational Purpose: The information provided on this Website is for general informational purposes. We make no representations or warranties, express or implied, regarding the accuracy, reliability, or completeness of any information.
- B. Disclaimer: The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Foundation disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
C. Limitation of Liability: In no event shall the Foundation, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, incidental, special, or punitive damages, including lost profits or lost data, arising from your use of the Website or any donation made, even if the Foundation has been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Foundation and its respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or relating to your violation of this Agreement or your use of the Website.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts of Jakarta, Indonesia.
10. Trademarks
You may not use any of our trademarks, trade names, service marks, copyrights, or logos in any way that suggests they belong to you or that you have our endorsement or approval. You agree that you have no ownership rights in any of our intellectual property. This includes, but isn’t limited to, any brand names, product names, logos, and any other distinctive signs or designs we own.
11. Changes to the Terms of Use
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts of Jakarta, Indonesia.
